The ICC’s terrible, horrible, no good, very bad day

How Kenyans are reacting to the end of the Ruto and Sang ICC case.

This is what winning looks like. 

 
 
 
William Ruto and Joshua Sang on Tuesday had the look of men who had just given the ICC a one-two punch. After a trial that lasted slightly over two years, the pair became the last of the “Ocampo 6” to walk away scott-free. Trial Chamber V(a) judges, refusing to call it an acquittal, grudgingly let them off the hook, declaring a mistrial due what they called a “troubling incidence of witness interference and intolerable political meddling”. 
 

 

 
 
But anyone finding some comfort in the fact that a “mistrial” was declared and not the “no case to answer” or “judgment of acquittal” that Ruto and Sang had applied for is mistaken. They are like the football fan who looks to the scoreboard for consolation after a narrow defeat. The real winners are always the ones running around the pitch in celebration. Ruto and Sang’s supporters are certainly paying no mind to legal technicalities. 
 
 
 
 
Prof Makau Mutua, who has all along been one of the fiercest defenders of the ICC in Kenya, had some harsh words of caution for those celebrating Ruto and Sang’s victory.
 
 
 
Hours after the Trial Chamber’s decision was made public, reactions were still pouring thick and fast. The “congratulations” that has reverberated most has been from President Uhuru Kenyatta, who wasted no time in reminding everyone that he knew this day was coming. 
 
 
 
 
 
President Kenyatta, who wrote the playbook on how to beat the ICC without going to trial, is certainly no fan of the Court. One man who is a fan, however, is prominent Kenyan lawyer Ekuru Aukot. Aukot, who has already announced his intentions to dislodge Kenyatta from the presidency in 2017. He thinks the 2007/08 PEV victims deserve justice, and he has a few ideas to on how this can be done. 
 
 
 
Aukot, who helped draft Kenya’s current constitution, isn’t just limiting himself to changes in strategy at the ICC prosecutor’s office. He also thinks some changes back home could make the difference in whether PEV victims get justice. 
 
 
Like Aukot, Kenyan cartoonist and pundit Patrick Gathara is miffed that the local legal machinery has hardly done a thing for PEV victims, eights years on. 
 
 
 
Meanwhile, award-winning photojournalist and activist Boniface Mwangi thinks it's time President Kenyatta made good on his promise to set up a Ksh 10 billion restorative fund for victims.
 
 
Some Kenyans are also worried what message the end of the “Ocampo 6” cases – not mention the utter failure to punish the perpetrators of the PEV violence - is sending to the electorate in 2017. 
 
 
 
Thanksgiving prayers are being planned to thank the almighty for delivering Ruto and Sang from the maw of The Hague. Gabriel Dolan, a Catholic priest and an activist in his own right, says he can think of a group of people more deserving of the prayers.
